PRESENT:              Mayor Matthew Deeth, Cr Judith Hannan, Cr Robert Khan, Cr Michael Banasik, Cr Matthew Gould, Cr Blair Briggs, Cr Simon Landow, Cr Noel Lowry

1          Opening

Legislative changes to the Local Government Act, section 747A now permits Council meetings to be held remotely using audio visual link and is open to members of the community via webcast.

2          Recording of the Meeting

In accordance with Council’s Code of Meeting Practice the electronic recording of the Council Meeting and the use of electronic media during the proceedings is not permitted. This includes devices such as laptops, mobile phones, tape recorders and video cameras.

3          Webcast Notice

Members of the public are advised that open sessions of this meeting are webcast live for public viewing on Council’s website. Audio and video footage taken is of the governing body and staff.

7          Declaration of Interest

Mayor Matthew Deeth declared a Pecuniary Conflict of Interest in relation to item 11.1 - Voluntary Planning Agreement (Draft VPA) for 30 Tickle Drive, Thirlmere as a family members property is near the subject property. The Mayor advised he would leave the meeting and not vote on this matter.

Cr Briggs declared a Pecuniary Conflict of Interest in item 15.4 – Farmland Rating Policy. Cr Briggs advised he would leave the meeting and not vote on this matter.

10        Mayoral Minute

10.1       Mayoral Minute

 

This Mayoral Minute provides an update on key events attended by the Mayor or Councillors over the past month (Attachment 1) and also seeks Council endorsement to progress two current issues.

 

1. NSW Parliamentary Koala Inquiry Findings and Recommendations

 

I welcome the release of the NSW Parliamentary Koala Inquiry Findings and Recommendation and acknowledgment of the significance of the local Macarthur koala population and note that the inquiry also highlights the importance of the koala population of south-western Sydney. The report found that at least 5,000 koalas died in recent bushfires in NSW and more than 80 per cent of some habitat areas were destroyed.  It is estimated up to 800 koalas between Campbelltown and Wilton in the Wollondilly shire were extremely vulnerable because of urban expansion and roads. The committee found that the exclusion fencing on Appin Road is dangerous and needs to be removed or at least needs to include overpasses and underpasses to protect koalas in that area, this is important for Council to include in the future growth areas in Appin.  Additionally, one of the recommendations is about the creation of the Georges River National Park, which will protect, to some extent the significant koala population in south-west Sydney.  Council does not want to see the extinction of this iconic species and would like to see opportunities for their protection established in the local area.

I would like to recommend that Council write to the Premier and relevant Government Ministers welcoming the release of the Report and its findings and requesting adoption of selected recommendations (that are relevant to Wollondilly LGA).

 

2. Wollondilly Netball Association and the Impacts of COVID-19

 

The 2020 and potentially the 2021 Netball Seasons have been significantly impacted by the necessary application of the NSW Public Health Order restricting gatherings and group sports.

The Wollondilly Netball Association (WNA) have had to make the hard decision to cancel the entire 2020 season which has an immediate impact on all junior and senior players in Wollondilly and potentially longer term impacts due to the significant interruption and the reductions in sponsorship revenues due to the wide spread economic downturn.

Council has been endeavouring to support Netball in the longer term with a significant investment in the upgrading of the 12 netball courts at the Tahmoor District Sporting Complex; however, the Association is facing immediate financial issues due to committed contributions and expenditures through to their governing body, NSW Netball, as well as supporting their prospective representative players so as to not lose representative opportunities over the coming years for participants in this very popular community sport.

Netball NSW have recently advised Wollondilly Netball that they will refund 2020 registration contributions for all players that are deregistering for 2020; however, this still leaves unrecoverable out of pocket expenses for WNA and the players they support. For example, expenses for the 2020 representative season exceed $20,000 and general season preparation cost of in excess of $9,000.

Council remains supportive of Netball in Wollondilly as an important community, district and state health and sporting activity from juniors through to seniors and representative players.

To demonstrate this ongoing support, I move that Council:

1.       Writes to Netball NSW to thank them for agreeing to refund the registration fee contributions for players deregistering for 2020 and ask that they be generous in their interpretation of player’s intentions to deregister.

2.       Writes to the NSW Minister for Sport, the Hon. John Sidoti MP, requesting financial support for the Wollondilly Netball Association and their member clubs, for meeting out of pocket expenses such that they can be financially viable for the 2021 season and use the 12 new courts that are being jointly funded by the NSW Government, Australian Government and Wollondilly Council at the Tahmoor District Sporting Complex.

3.       Writes to the Member for Hume, the Hon. Angus Taylor MP, requesting additional financial support for the Wollondilly Netball Association and their member clubs, for meeting out of pocket expenses such that they can be finically viable for the 2021 season and use the 12 new courts that are being jointly funded by the NSW Government, Australian Government and Wollondilly Council at the Tahmoor District Sporting Complex.

4.       Thank Wollondilly Netball Association for their ongoing support and leadership of Netball in Wollondilly and for their assistance in planning and attracting funding for the upgrade of the Netball Courts at Tahmoor.

1.       Adopts the Planning Agreement attached to this report;

2.       Authorises the Chief Executive Officer to Execute the Planning Agreement on behalf of Council;

4.      As a matter of urgency an area for a park be identified in the east Thirlmere area.

That Council accepts the following recommendations of the Rural Industry Community Advisory Committee meeting held on 3 June 2020:

1.       That the Rural Industry Community Advisory Committee requests that the minutes of each meeting be circulated by email, to all members of RICAC for adoption, as soon as possible to meet the deadline for the following months Ordinary Council Meeting.

2.       That the Rural Industry Community Advisory Committee minutes be accepted by email.

1.       That Council place the Draft Library Strategy 2020 - 2026 on public exhibition for a period of 28 days to allow the public to provide feedback.

2.       That Council note that this is an aspirational document which will need further prioritisation of actions as part of a more detailed implementation and funding strategy to be reported back to Council.

15.1       Exhibition of the Draft Code of Meeting Practice

1.       That the Code of Meeting Practice be amended to provide a new clause 3.9 which provides that a maximum of up to two notices of motion per Councillor may be submitted for consideration at each Ordinary Council Meeting.

2.       The draft Code of Meeting Practice be placed on public exhibition for a period of 28 days with a further 14 day submission period prior to coming back to Council for adoption.

1.      That Council adopts the draft Farmland Rating Policy, and

2.    That Council undertake further consultation, as part of the preparation of the 2021-22 Operational plan, to consider introduction of sub-categories in accordance with section 529 (2)(a) the Local Government Act 1996 which allows for sub-categorisation “according to the intensity of land use, the irrigability of the land or economic factors affecting the land.

3.     That this recommendation be referred to the Rural Liaison Committee for comment and any other alternatives for the future.

15.5       2020 Local Government Remuneration Tribunal Determination

That Council:

1.       Note the Local Government Remuneration Tribunal determination to change Wollondilly Shire Council’s category from Regional Rural to Regional Centre.

2.       Determine the fees payable to Councillors is $20,280 and the Mayor is $44,250 (in addition to the Councillor Fee), which remains consistent with the 16 June 2020 resolution.

3.       Note it is required to formally set the fees payable within a set range each year following the Tribunal determination and that the maximum fee was previously applied under our former category.
